Business Claims Procedures 

 

Public/Product Liability claims

 

This covers liability to third parties from losses or damage caused by negligence on the insured’s behalf. This policy may cover some of the operational aspects of the business as well as accidents caused by negligence that occur on the premises named on the policy.

 

As soon as you become aware of an incident it is imperative:-

 

  • Notice must be given of any circumstances that could give rise to a claim

  • No admission, offer, promise, payment or indemnity shall be made or given by or on behalf of the Insured without the written consent of Bell Insurance Services Limited/Insurer which shall be entitled to take over and conduct in the name of the Insured the defense or settlement of any claim or to or to prosecute in the name of the Insured.

  • In the event the claimant has insurance to cover loss to their affected property, they should be directed, in an amicable manner to us for advice on claim procedures.

  • Preserve evidence which may prove useful in defending any action

  • Take reasonable care to maintain premises in sound condition and comply with all statutory obligations, by laws or regulations concerning the safety of persons or property

 

1. Obtain full details as follows:

 

  • Date and time of accident or knowledge of possible damage arising from same, if the incident took place at a branch get the Manager to submit full report on the matter. The managers report should cover if it was a slip & fall:- what occurred, the comments of the people involved, (if help was offered) what help was offered to person, a comment on the severity of the incident.

  • Location and description of accident

  • Details of the injured person/damaged property.

  • Names and contact info of Witnesses (if applicable) and report from them as described above. ( if possible)

  • Complete the necessary Claim Form, available here.

  • Keep us informed of any developments / correspondence as they arise.

  • Bell Insurance Services Limited will be there when you have to meet with Adjusters / Insurers  to guide and assist in advocating your positions and get agreement as to the nature and extent of loss or damage (if any)

  • Once claim is submitted, Bell Insurance Services Limited will liaise with both the adjuster and insurer till claim is finalized.


2. Direct all correspondence, notices, writs, summons or written communication to us who will deal directly with claimants and advise them on the name of the procedures and Adjuster appointed on your behalf to deal with the matter.


3. If the incident involves serious bodily injury arises; obtain emergency medical attention through the public system EMS. However, under no condition should you admit liability or offer or promise to pay monies without the express consent of the Insurer.

 

 

Other Liability claims

 

As soon as you become aware of an incident that may give rise to a Liability claim, you should contact us and follow these steps:

 

1. Obtain Particulars and full details

Date, time and location of the accident

Details of the injured/affected person/damaged property

Witnesses (if applicable)

Photographs of accident (if available)

Complete the Claim Form available here

 

2. If the accident brings on serious bodily injury to any persons, obtain

emergency medical attention. However, we stress that no admission to

liability or promise of payment to the affected person be given without

the express consent of the insurer.

 

Direct all correspondence, notices, writs, summons or written communication to us who will deal directly with claimants and advise them on the name of the procedures and Adjuster appointed on your behalf to deal with the matter.

 


Workmen’s Compensation claims

 

As soon as you become aware of an employee’s incident/injury sustained on the job  that may give rise to a Workmen’s compensation claim, you should contact us immediately and the following steps must be followed to process a claim:

 

  1. Complete the Accident Report / Claims Form available here

  2. Validate the wages paid to the affected employee during his/her period of illness, by obtaining a signed statement by the employee or payment vouchers

  3. Submit a sick leave certificate for the entire period of absence if this is in excess of three (3) working days

 

Provide final fitness certificate / medical report pronouncing the employee is fit to resume normal work duties, and advise whether the employee has suffered any permanent partial disability.

 

Once the claim documents are submitted, the circumstances of the claim will be investigated by the insurer’s loss adjuster and a settlement between yourself and the Insurer’s will be made.

 

 

 

Cash in Transit claims

 

This covers all risk of physical loss or damage to money while being transported to and from a Bank and while on premises. Losses will include hold-up, robbery and/or theft and the policy can also be extended to cover loss of a limited sum of cash whilst in a locked safe outside of business hours. In special cases the policy may also be extended to cover cash whilst securely kept on the premises of a director.

 

In the event of a loss you should do the following:

 

  1. Notify the police immediately

  2. Contact Bell Insurance Services Limited immediately.

  3. Prepare notice in writing to us stating the circumstances of the loss.  

  4. Take immediate steps to ascertain the full extent of loss and obtain all particulars and documents of evidence to substantiate your claim to insurers.

  5. Present a detailed Statement of Claim with the supporting documentation including Claim Form available here to Bell Insurance Services Limited.

  6. Keep us informed of any developments as they arise

  7. Bell will be there when you have to meet with Adjusters/Insurers, establish to guide and assist in advocating your positions and see the matter to conclusion

 

Once claim is submitted Bell Insurance Services Limited will liaise with both the adjuster and insurer until the claim is finalized.

 

There are several things you can do in order to greatly reduce the likelihood of suffering a cash loss.

 

  • Staggering times and dates of bank visits so that they are unpredictable to the observer

  • Try as much as possible to reduce the amount of cash carried by an unprotected person at any one time – if large quantities of cash must be moved, consider having an armored guard service instead of an employee.

  • Small, regular deposits are preferable to large weekly ones

  • Having a system whereby cash is put in a locked safe (with a deposit slot) at specified intervals would reduce the amount lost in a hold-up or burglary, provided that the key to the safe was kept off-site, of course.

 

 

Goods in Transit claim

 

If you face a loss or damage to your goods from a collision, theft, hold-up etc. while being transported to and from your premises, as well to suppliers and customers premises, please contact us immediately and follow these steps:

 

  1. Notify the police immediately

  2. Prepare in writing to us stating the circumstances of the matter

  3. Obtain full extent of claims and obtain all particulars, including documents to evidence and substantiate your claim.

  4. Submit all documents to us including the completed Claim Form available here

 

Once the claim documents are submitted, the circumstances of the claim will be investigated by the insurer’s loss adjuster and a settlement between yourself and the Insurer’s will be made.

 

 

Fidelity Guarantee claim

 

If you are faced with larceny, fraud, guarantee embezzlement or misappropriation upon the part of any employee in your organisation, you should contact us immediately and follow these steps:

 

  1. Once you suspect a loss or discover a loss, prepare and send a notice in writing, of particulars of the acts or defiance of the employee to us. All claims must be reported within 3 months of discovery.

  2. Notify the police

  3. Obtain full details of the claim and ascertain all details, particulars and documents to support your evidence of a claim

  4. Obtain all information which can lead to the whereabouts, if unknown, of the employee

  5. All monies due to the employee/suspect to be deducted from the amount claimed

  6. Submit all documents and Claim Form available here to Bell Insurance Services Limited to process this claim with the insurers

 

Once the claim documents are submitted, the circumstances of the claim will be investigated by the insurer’s loss adjuster and a settlement between yourself and the Insurer’s will be made.

 

 

All other Commercial claims

 

If you face a commercial loss or physical damage, we recommend you contact us immediately and provide the following information:

 

  1. Completed Claim form available here

  2. Date of loss and details of loss

  3. Circumstances of claim and details of what has been damaged

  4. Purchase invoices/delivery receipts

  5. Technical/damage report on extent of damages (applicable for machinery losses)

  6. Police Reports (if available)

  7. Photographs of damage

  8. Estimation of costs / invoices for repair

 

Once the claim documents are submitted, the circumstances of the claim will be investigated by the insurer’s loss adjuster and a settlement between yourself and the Insurer’s will be made.
